Role of Artificial Intelligence in Enhancing Decisions: Forensic Medicine as a Model

Abstract

Nations and countries have expressed increasing concerns about modern machine technologies, with artificial intelligence emerging in the eyes of some as a substitute rather than a complement to the human mind. This research aims at proposing solutions to some real challenges. Like any other, the researcher sees artificial intelligence as a tool capable of enhancing human decisions, improving the consequences of actions, and providing impartial and well-crafted strategies and plans to aid in making optimal decisions in various aspects of life. This research offers solutions to two problems in forensic and criminal medicine: confirming death in clinical death cases and determining the sex of intersex individuals. The outcomes could lead to significant consequences, such as the disconnection of life support devices from patients with brainstem death (clinically dead) or the placement of intersex individuals in appropriate detention facilities. A model specific to the Arab world has been developed by researching and comparing international regulations. The research will also delve into other aspects of the topic, alongside a review of literature recommending the regulation and active oversight of artificial intelligence to maintain national and international security. The proposed solutions will be a serious attempt to advance the Arab world and preserve Arab identity by solving criminal issues and defining the stance of state institutions on artificial intelligence and the legal personality of machines. The discussion will primarily focus on enhancing forensic medical decisions through artificial intelligence and the position of artificial intelligence in courts and the judiciary. The solutions proposed will not be limited to a specific issue but could be broader to include larger aspects of Arab life. The research concludes by reinforcing specific decisions within a defined framework through artificial intelligence, considering various ethical and legal aspects. The methodology used in this research is generally a comparative methodology, as we will compare the systems and public policies of several countries until it becomes clear what is most appropriate for application in our Arab society. We conclude by suggesting that Arab policies adopt a balanced approach and learn from the experiences of Russia, Japan, and Korea, where we embrace innovation without engaging in moral and legal paradoxes.
